Ethics demand that we agree on fees prior to the commencement of any work.
As an independent attorney, I enjoy significant flexibility. I consider this an advantage for me as well as for you. As a commercial entity, I also need to be able to plan ahead. This means evaluating the work that needs to be done, managing externalities and expectations. That goes for you as much as it applies to me. As a general rule, I work on an hourly rate basis. But I don't rule out alternative billing arrangements provided they are viable. When working on an hourly rate basis, I will always provide you with a fee estimate beforehand. Where such estimate needs to be, or is likely to have to be, reconsidered, I will always let you know ahead of time. I adapt rates on the basis of the technicality, complexity and urgency of the matter. When we agree to flat fee arrangements, I will apply averaged hourly rates that incorporate the various billing rates of professionals staffed on the matter. Regardless of the arrangement, I neither bill for travel time nor for invoicing time. |
